Important: QuackPDFTools is a client-side tool — we do not host, store, or have access to any files users process. DMCA notices should relate to content published on our website (blog posts, images, text), not files processed through our tools.

1. Overview

QuackPDFTools ("we," "us," "our") respects the intellectual property rights of others and expects users of our Service to do the same. We comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and respond to valid notices of copyright infringement.

This policy describes how we handle DMCA takedown notices and counter-notices related to content published on the QuackPDFTools website (quackpdftools.com).

2. Our Nature as a Client-Side Tool

It is critical to understand the nature of QuackPDFTools before submitting a DMCA notice:

  • We do not host user files. All PDF processing happens entirely in the user's browser. Files are never uploaded to, transmitted to, or stored on our servers.
  • We cannot access user files. We have no technical ability to view, copy, or distribute files that users process with our tools.
  • We are not a file-sharing platform. We do not facilitate the sharing of files between users.

Therefore, DMCA notices regarding files that a user has personally processed through our tools (e.g., "someone used your tool to copy my PDF") are not actionable against us. The tool itself does not infringe copyright — any potential infringement would be by the individual user acting outside our Terms of Service.

Valid DMCA notices must relate to copyrighted content that we have published on our website, such as blog post text, images, code, or other website content.

3. Reporting Copyright Infringement

If you believe that content published on QuackPDFTools infringes your copyright, you may submit a DMCA takedown notice to our designated copyright agent. Upon receipt of a valid notice, we will:

  1. Acknowledge receipt within 5 business days
  2. Review the notice for completeness and validity
  3. Remove or disable access to the allegedly infringing content promptly if the notice is valid
  4. Notify the user or author of the content that it has been removed
  5. Provide information about the counter-notice process

4. DMCA Notice Requirements

To be valid under the DMCA, your notice must include all of the following elements (17 U.S.C. § 512(c)(3)):

  1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of the material you claim is infringing, with enough detail for us to locate it on our website. Please include the specific URL(s).
  3. Your contact information: Your name, address, telephone number, and email address.
  4. Statement of good faith: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy: A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Notices that are incomplete or do not meet these requirements may not be acted upon. We reserve the right to request additional information to validate a notice.

Submit Your DMCA Notice

Email: dmca@quackpdftools.com
Subject line: DMCA Takedown Notice — [brief description]
Contact form: quackpdftools.com/contact.html

We aim to acknowledge all DMCA notices within 5 business days.

5. Counter-Notice Process

If you believe that content removed in response to a DMCA notice is not infringing, or that you have authorization from the copyright owner, the copyright owner's agent, or the law to use the content, you may submit a counter-notice.

A valid counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the content that was removed and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of the federal district court in your district (or, if outside the US, any judicial district in which QuackPDFTools may be found)
  6. A statement that you will accept service of process from the person who filed the original DMCA notice

Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a lawsuit within 10-14 business days, we may restore the removed content.

6. Repeat Infringer Policy

QuackPDFTools will, in appropriate circumstances, terminate the accounts or block access of users who are found to be repeat infringers. We consider a user to be a "repeat infringer" if they have been the subject of more than two valid DMCA complaints within a 12-month period.

Since QuackPDFTools does not require user registration, repeat infringer enforcement is implemented through IP-based blocking and other technical measures.

7. False or Misleading Claims

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including costs and attorneys' fees.

We encourage you to consult with a legal professional before submitting a DMCA notice if you are unsure whether the material in question is actually infringing.

8. DMCA Agent Contact Information

Our designated DMCA agent for receipt of copyright infringement notices is:

DMCA Agent: QuackPDFTools Legal
Email: dmca@quackpdftools.com
General contact: quackpdftools.com/contact.html

Please use "DMCA Notice" as your email subject line for fastest processing.

We respond to all valid DMCA notices promptly and take copyright protection seriously.
